LandingTalent.com Connects Talent and Customers
LandingTalent.com is a communications platform for enabling the connection between individuals seeking to obtain event services (“JobPosters”) and/or individuals seeking to provide job services (“Talent”). JobPosters and Talent together are hereinafter referred to as “Users.” Those certain talent services requested by the JobPosters, which are to be completed by the Talent are hereinafter referred to as “Jobs”
LandingTalent.com is Only a Venue
LandingTalent.com is a communications platform for enabling connections between Users. LandingTalent.com does not take part in the interaction between Users. LandingTalent.com does not have control over the quality, timing, legality, failure to provide, or any other aspect whatsoever of any Jobs provided by jobposters, nor of the integrity, responsibility or any of the actions or omissions whatsoever of any Users. LandingTalent.com does not have control over the quality, timing or legality of Jobs delivered by its Talent. LandingTalent.com makes no representations about the suitability, reliability, timeliness, or accuracy of the Jobs requested and provided by Users identified through the Service whether in public, private, or offline interactions. Although LandingTalent.com does perform background checks of Talent, as outlined in more detail below, LandingTalent.com cannot confirm that each User is who they claim to be. LandingTalent.com does not assume any responsibility for the accuracy or reliability of this information or any information on the Service.
LandingTalent.com does check the backgrounds of Talent, via a third party service called Acxiom. However, when interacting with other Users you should exercise caution and common sense to protect your personal safety and property, just as you would when interacting with other persons whom you don’t know. NEITHER LANDINGTALENT.COM NOR ITS AFFILIATES OR LICENSORS IS RESPONSIBLE FOR THE CONDUCT, WHETHER ONLINE OR OFFLINE, OF ANY USER OF THE SERVICE. LANDINGTALENT.COM AND ITS AFFILIATES AND LICENSORS WILL NOT BE LIABLE FOR ANY CLAIM, INJURY OR DAMAGE ARISING IN CONNECTION WITH YOUR USE OF THE SERVICE.
Users of the Service contract for Jobs directly with other Users. LandingTalent.com will not be a party to any contracts for Jobs or services. LandingTalent.com facilitates these contracts by supplying a medium for the exchange of money. Credits can be prepurchased by Jobposters in bulk, or payment can be processed at the end of a completed Job transaction. Jobposters offer JobPayments for each requested job run. When a Job is marked as closed by the JobPoster, the agreed upon JobPayment will be transferred to the Talent Runner’s online account. When the Job is marked complete by the Talent, which is an optional action, the JobPoster will have three (3) days before the Job is automatically marked complete in the system database and the Talent is paid the agreed upon JobPayment. The JobPayment must be paid through the LandingTalent.com Web Service. Any JobPayments paid in cash outside of the LandingTalent.com Web Service are NOT subject to refunds. Any reimbursement expenses that are incurred by a Talent in connection with the completion of a Job may, however, be paid in cash offline or through the LandingTalent.com Web Service.
LandingTalent.com is only a venue for connecting Users. Because LandingTalent.com is not involved in the actual contact between Users or in the completion of the Job, in the event that you have a dispute with one or more Users, you release LandingTalent.com (and our officers, directors, agents, investors, subsidiaries, and employees) from any and all claims, demands, or damages (actual or consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.
LandingTalent.com expressly disclaims any liability that may arise between Users of its Service.
If you are a California resident, you waive California Civil Code Section 1542, which says: “A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which, if known by him must have materially affected his settlement with the debtor.”
The Service may contain profiles, email systems, blogs, message boards, applications, job postings, chat areas, news groups, forums, communities and/or other message or communication facilities (“Public Areas”) that allow Users to communicate with other Users.
